Condo HVAC FAQ

Condo HVAC generates more questions per square foot than any other building type we service. I’m Jake from Alpine HVAC, and between board meetings, property managers, and owners who just want their suite comfortable, we hear the same questions on repeat across Hamilton. So here they are in one place, with the same answers I give in person. A quick note before we start: where responsibility and insurance are involved, your building’s declaration and a condo lawyer have the final word. This is general information from the mechanical side of the equation, not legal advice.

1. Who is responsible for HVAC in a Hamilton condo?

Who actually owns each piece of the HVAC puzzle in a condo? The short version: under Ontario’s Condominium Act, 1998, the corporation maintains the common elements, and owners maintain their own units. Central boilers, chillers, cooling towers, and shared rooftop units are the corporation’s responsibility. The fan coil, heat pump, or thermostat inside your suite is normally yours. Equipment that sits outside a unit but serves only that unit, like a balcony condenser, is the grey zone your declaration decides. 2. Who pays when the building’s central heating or cooling fails?

When central heating or cooling goes down, who covers the repair? The corporation does, because shared systems are common elements, and the cost flows through the operating budget or the reserve fund depending on scale. What owners should understand is that this is exactly what condo fees and reserve contributions exist for. A corporation that maintains its central plant on a proper maintenance contract pays for small planned repairs; a corporation that skips maintenance pays for emergency replacements and special assessments. Same equipment, very different invoices.

3. Can I replace the fan coil or heat pump in my own suite?

Can an owner just swap out their own in-suite equipment? Usually yes, but not unilaterally. Most buildings require written approval from the board or property manager before in-suite HVAC work, and for good reason: your new equipment has to be compatible with the building’s central systems, and a bad installation can leak into the suite below, which drags the corporation’s insurance into your renovation. Use a licensed contractor, get the approval in writing, and keep the documentation. 4. What happens if my in-suite HVAC leaks and damages the unit below?

What happens after an in-suite leak spreads beyond your suite? Two different questions get answered at once, and they can land on different people. Repairing the worn-out equipment itself is a maintenance issue, which for in-suite equipment usually falls to the owner. Repairing the resulting damage to other units and common elements typically involves the corporation and its insurance, and depending on the declaration and the circumstances, the deductible can be charged back to the owner whose equipment failed. The details are legal territory, so this is one to take to your property manager and, if it gets contested, a condo lawyer. From the mechanical side, our advice is simpler: maintained equipment leaks a lot less often, and condensate lines are cheap to inspect.

5. When does the building switch from heating to cooling?

Why can you not get cooling in a warm April, or heat in a cold October? In many older condo buildings, the answer is pipes. Buildings with two-pipe systems circulate either hot or chilled water through the whole building, not both at once, so the corporation schedules a seasonal changeover in spring and fall, and every suite lives with that choice until the next switch. Four-pipe buildings can heat and cool simultaneously, so suites get what they call for year-round. If shoulder-season complaints dominate your board meetings, it is worth knowing which system you have and whether controls upgrades can smooth the changeover windows. It will not turn two pipes into four, but smarter scheduling and monitoring make the switch far less painful.

6. Why is my suite too hot or too cold when the system seems fine?

Why does one suite roast while the building says everything is normal? Usually because the problem is local. Clogged fan coil filters, fouled coils, air-bound piping, failed valves, and miscalibrated thermostats all produce a suite that fights the building around it. Stack effect in taller buildings adds its own drama, pushing heat upward in winter. 7. What maintenance should owners do, and what does the corporation handle?

Who maintains what, day to day? Owners: keep in-suite filters clean, keep furniture and drapes off fan coil intakes, watch for condensate drips, and report odd noises early instead of living with them. The corporation: seasonal service on the central plant, ventilation and make-up air, riser flushing and water treatment where applicable, and the preventative maintenance schedule that keeps all of it honest. The buildings with the fewest HVAC complaints are almost always the ones where both halves of that split actually happen.

8. Should HVAC be in our reserve fund study?

Does HVAC belong in the reserve fund study? Emphatically yes. Boilers, chillers, cooling towers, and rooftop units are among the largest capital items a corporation will ever fund, and their replacement timing should be a planned line in the study, not a surprise. The input that makes a study realistic is honest condition data: age, service history, efficiency trends, and a technician’s lifecycle opinion in writing. 9. Can an older condo building be automated?

Is automation realistic for a building from the 1970s or 1980s? Yes, and older buildings often benefit most. For a corporation, the win is twofold: fewer emergency calls because problems get flagged early, and clean energy data that makes budget conversations shorter.
